Terms + conditions

Please read these terms and conditions carefully. You must not accept any booking unless you understand and agree with the following terms and conditions. A payment of a deposit indicates acceptance of all conditions below by you and or your client.

Deposit/Final Payment

Your deposit is due at the time of booking and is used to pay hotel, tickets and other deposits. It is non-refundable in the event of your cancellation.

Final payment is due 60 days before departure. Failure to make the final payment by your due date may result in cancellation of your booking and loss of deposit.

Payment is accepted by cheque, bank transfer and most credit cards. A surcharge will apply when paying by credit cards and will be determined by the credit card type. This will be advised at the time of booking.

Cancellations & Refund

Cancellations by you – Cancellation charges will be applied as shown below, calculated from the day written notice is received by Travel Your Way. Policy must be sighted by us before departure. Travel insurance can be arranged by Travel Your Way.

Fitness and Participation

For the overall benefit of the group, all tour members must possess a moderate level of mobility including the ability to:

  • Negotiate airports and railway stations without wheelchair assistance
  • Use combined shower/bath facilities (it is impossible to guarantee a walk-in shower facility)
  • Undertake walking tours of 2-3 hours duration using stairs, walking over cobblestones and other uneven surfaces
  • Stand for periods in museums and other sites
  • Get onto and off coaches, trains and other methods of transportation without assistance
  • Handle your own luggage.

If you (or we) have any doubts about your ability to participate in your chosen tour, you may be required to have a doctor’s appraisal. This would require a doctor to read the itinerary of your chosen tour and provide you with written confirmation of your ability to participate.

Tour Leaders

Travel Your Way reserves the right to change at any time the tour leader. If this happens Travel Your Way will try to ensure that the alternative leader has expertise commensurate with that of the tour leader. Any such change by Travel Your Way will not give rise to any right on your part to cancel the tour, claim any expenses, loss or damage which may be suffered.

While on tour there may be instances where you wish to join the tour leader in free time outside the program which may involve catching taxis, using public transport to shopping and dinner locations. The tour leader and Travel Your Way will not be liable for any accident, injury, death, property damage or loss in relation to such activities.

Tour Prices

Tour prices are based on ground costs, fuel prices, exchange rates and assumptions are made at the time of printing the itinerary. Travel Your Way tries not to increase tour prices, however sometimes increases are outside our control. Travel Your Way reserves the right to amend tour prices without notice at any time up to 60 days before departure. Any increases in tour prices must be paid for prior to the departure date.

Changes

Changes by you – because of additional communication and other expenses, we reserve the right to charge an appropriate administration fee per amendment for your original booking. While every effort will be made to accommodate changes and additional requests their availability cannot be guaranteed.

Changes by us – while we will use our best endeavours to operate tours as advertised, you should understand that the trip’s route, accommodation and modes of transport are subject to change without prior notice due to local circumstances. Should Travel Your Way deem it advisable to amend an itinerary for any reason, it may do so by shortening, varying or re-routing any trip. These changes are binding and additional expenses will be charged to you if the reason for any alteration is outside Travel Your Way’s control. Further, Travel Your Way is not responsible for any penalty charges associated with supersaver type connection rail or airfares in the event of changes to a holiday departure time, date or airport.

Responsibilities

While travelling with Travel Your way you agree to obey the laws and regulations of the countries visited and any failure to do so will relieve Travel Your Way of any obligation that they may otherwise have under the booking conditions. Travellers are also required to accept the authority of the Tour Leader at all times. You are aware that travel within a group may involve compromise to accommodate diverse desires and physical abilities of group members. You understand that Travel Your Way reserves the right to decline, accept or retain any person as a member of the group at any time.

You acknowledge that Travel Your Way contracts with a network of companies, government agencies and individuals to assist in the running of its tours. To the best of Travel Your Way’s knowledge, these third parties are qualified to perform the duties they are contracted to perform.

Where operational control of the tour is in the hands of a third party your right of action in regards to any shortcomings of the third party’s performance is against the third party and not against Travel Your Way. Travel Your Way therefore will not be liable for any injury, damage, loss, delay or irregularity that may occur due to the behaviour of these third parties. No employees or agent of Travel Your Way has authority to vary these conditions. Privacy You permit Travel Your Way to collect personal information from you or your medical practitioner regarding your health and medical condition. You acknowledge that the personal information may be disclosed to Travel Our Way in order to ensure your safety and wellbeing but will not be used by them for any other purpose.

Complaints

If you have any complaints about your tour, you must make it known at the earliest opportunity to the tour leader who will endeavour to resolve the issue at the time. If at the end of the trip you feel your compliant was not properly dealt with you must notify Travel Your Way in writing within 30 days at the end of your trip.
